WHAT HAPPENS IF THE SHIPMENT DOES NOT MEET THE REQUIREMENTS?
If the shipment does not meet the requirements of Postal Traffic and Express shipments, it will change mode and will require nationalization under another form of importation.
Value Adjustment:
If the declared value of the shipment does not correspond to the actual value of the merchandise, it will be subject to a value proposal, which generates an adjustment in the payment of customs duties.
Modality change:
When declaring in postal traffic and express shipments, the requirements are not met, which implies changing the import modality by transferring the shipment to a warehouse.
Abandonment:
If a month passes without sending it by postal traffic or express delivery, it is considered abandoned. You can recover it in the following month by paying customs duties and an extra 10%. If you do not do so, it will become the property of the Nation and you will not be able to recover it.
Direct seizure or confiscation:
When the merchandise is prohibited, not described or not covered by the transport document (postal or air waybill) or express manifest.
CAN I EXERCISE MY RIGHT OF DEFENSE IF THE VALUE IS DISPUTED?
Yes, you can do so by presenting the invoice or equivalent document to your advisor. You must do so within 2 days after the request from the customs authority or within the month following the arrival of the goods in the country. Claims will be processed as a right of petition, according to law 1755 of 2015.
